The proposed regulations are identical in content; the only difference being that the emergency regulation would take effect immediately. The permanent regulation would take effect July 1, 2006
The emergency regulation and companion permanent regulation adopt a schedule of tuition and fees mandated by the Legislature. The legislation requires a 3% increase, from $71.57 to $73.71 per credit hour, to the undergraduate tuition (matriculation fee); other increases are BOT optional up to 5% for students enrolled prior to the fall of 2006 and 10% for students enrolled after Fall 2006 [Intended to define new students as those beginning in Fall 2006]. The legislation also prohibits university boards of trustees from lowering tuition.
The proposed regulations increase the matriculation fees for graduate and undergraduate students by 3%. In the professional schools, the Law School matriculation fees are increased 3% for existing students and 10% for new students, as defined by the legislature. The nonresident fee for continuing law students who started Fall, 2005 would increase 5% while the nonresident fee for new law students would increase 10%.SPECIFIC REASONS FOR FINDING AN IMMEDIATE DANGER TO THE HEALTH, SAFETY OR WELFARE: Section 1009.24 F.S. requires the Board of Trustees to set university tuition and fees to be charged by the University as authorized by the annual Appropriations Bill. On May 25, 2006, the 2006 General Appropriations Bill, Laws of Florida 2006-25, was signed by the Governor and filed with the Secretary of State to be effective July 1, 2006. Because the normal Regulation adoption procedure will take longer than the time before which tuition and fee bills must be assessed, an emergency regulation, as specifically authorized by Board of Governors procedures, is required and in the best interest of the public to maintain the crucial funding of university operations for the 2006-2007 academic year. This will be backed by an identical permanent regulation adopted under the routine procedure. The Board of Trustees of Florida State University will meet on June 9, 2006 to review the companion proposed emergency and permanent tuition and fee regulations.
REASON FOR CONCLUDING THAT THE PROCEDURE IS FAIR UNDER THE CIRCUMSTANCES: Adequate notice of the proposed action by the Board of Trustees was included in the published agenda of the June, 2006 meeting.
